Quotes and Estimates: All estimates and quotes generated through our website or digital scheduling systems are valid for a period of 30 days from the date of issuance, after which pricing and availability may be subject to change.
Inclusions: Project contracts strictly encompass the specific materials and line items explicitly outlined in the written bid. Any work requested beyond the initial scope will necessitate a formal change order and will incur additional labor and material costs.
Accuracy of Information: When requesting a quote or booking a service, you agree to provide accurate, current, and complete information regarding your property and contact details.
2. Property Access and Site Conditions
Access Grant: By approving a project or scheduling a service call, you grant Rain Gutters Maui, LLC and its technicians reasonable access to the specified property to inspect, install, or repair gutter systems.
Pre-Existing Conditions: We are not liable for project delays or system failures caused by pre-existing structural issues on the property, including but not limited to dry rot, compromised fascia boards, settling foundations, or roofline irregularities.
3. Intellectual Property
The Service and its original content, features, and functionality (including website text, design elements, graphics, and logos) are and will remain the exclusive property of Rain Gutters Maui, LLC and its licensors. Our trademarks and branding may not be used in connection with any product or service without our prior written consent.
4. Limitation of Liability
In no event shall Rain Gutters Maui, LLC, nor its directors, employees, partners, agents, suppliers, or affiliates, be liable for any indirect, incidental, special, consequential, or punitive damages, including without limitation, loss of profits, data, use, goodwill, or other intangible losses, resulting from:
Your access to or use of (or inability to access or use) our website.
Operational limitations of existing property drainage infrastructure beyond the new materials installed by our team.
Any unauthorized access, use, or alteration of your digital transmissions or personal data.
5. Governing Law
These Terms shall be governed and construed in accordance with the laws of the State of Hawaii, United States, without regard to its conflict of law provisions.
Our failure to enforce any right or provision of these Terms will not be considered a waiver of those rights. If any provision of these Terms is held to be invalid or unenforceable by a court, the remaining provisions of these Terms will remain in effect.
6. Changes to Terms
We reserve the right, at our sole discretion, to modify or replace these Terms at any time. If a revision is material, we will try to provide at least 30 days’ notice prior to any new terms taking effect. What constitutes a material change will be determined at our sole discretion.
